The Perkovic case: Mesic's little distance and discreete support President Stjepan Mesic about Josip Perkovic, penultimate time, to remind, declared:

And after appearance of German APB, President Mesic said to the same journalist:

Mesic: It's not son's guilt because of his father President Mesic is not familiar with details of Perkovic case, but he doesn't think that all the time emphasized fact that son of Josip Perkovic works in his office, could in any way damage reputation of the Office. I see that is emphasized in medias all the time, but I still don't know for a single case that a son before he was born could decide about his father or his choice of job. It haven't been seen anywhere, so it would be the first time in history in Croatia. It is clear that Josip Perkovic is Croatian citizen and that State of Croatia will treat him according to laws and regulations, which means that no kind of media or political pressures could be subject to this. The Law says that Croatian citizens couldn't be hand over just like that and that all cases as this one, should go to Croatian judicature and let them to Croatian courts, gave a comment President Mesic. In the same way Stjepan Mesic first declare that Hrvoje Petrac is under no investigation, so why then the complaints that with the tycoon is close Damir Loncaric, chief of OA (Intelligence Agency), whose appointment, against Racan's resistance, President publicly supported. When journalists close to Tomislav Karamarko, the present chief of POA, said that Hrvoje Petrac, by first instance verdict sentenced for kidnapping, is hiding in Israel, Mesic publicly confirmed that, else secret information, but also added that Petrac by Law has right on restoration of procedure, as soon as he comes to Croatia. At the end of 80-ties, Mesic by his own recognition to Ivica Djikic, the author of President's unofficial biography The Homeland Twist, monthly, at least twice a year, went on police to give a complaint because he was not getting the permission to make a passport.

-So we were driving like that for years, and was without passport for 15 years, explains Mesic, but avoids to talk, during those periodical visiting to police for his rejection note for passport, whether he talked with people who received him there and whether after those meetings in registers of Service for national security has left any notes about his chats with awake guardians of Yugoslav constitutional order, which was just going to hell. But, if Mesic really said something to agents and if they put that in record, it is absolutely insane to talk about his spy work for comunist intelligence services and really malicious and wrong to name Mesic as informer of Udba, what Jovic (Josip note Z.P.) and his likeminded persons didn't stop doing till today. Josip Jovic, as a chief editor of Slobodna Dalmacija, during the first Mesic's president preelection campaign, in continuations published supposed UDBA's files of later President. But, writes Djikic, Mesic is not disappointed with Jovic's behaviour, but at that time attitude of Drazen Budisa and Slobodan Budak, that the file is authentic. Slobodan Budak, for whom Mesic said to Djikic, that they were family friends, repeated by The Homeland Twist his opinion:

- So, I am convinced that police records, which were published by Slobodna Dalmacija authentic, and Mesic had to tell me about those contacts with Service of state security, because we were in good relations and enough close friends, said Budak. The Homeland Twist, page 200.

I am not the likeminded person of Drazen Budisa, and the least of Josip Jovic, but knowing that Josip Perkovic was chief of Udba's section for enemy emigration, in time when Stjepan Mesic asked for a passport, in order to visit his uncle emigrant in France, and all in light of present situation, I am more and more convinced that Slobodan Budak knows what he is talking about.

The replacement of chief editor of Vjesnik worry OSCE?
Antonella Cerasino, the spokeperson and menageress of the Office for medias and public relations of mission of OSCE in Croatia, in Jutarnji list from 17.10. on question about changes in print medias in Croatia, gave following statement:

- National medias placed in Zagreb are those in which journalists work according to professional standards, without political interference. What worries me is the fact that last several months happened several replacement of chief editors. In some cases the replacement of chief editor led to that on some other way, less balanced, are news followed. It would be good if the editors are replaced to make that media better, and not to make it more liable to political and financial influences. But, the situation in general in print medias is rather good.

If the attitude of OSCE about situation in print medias is like this I could insinuate from letter which I got from them about a month before, where on my complaints that I got dismissal in Vjesnik because of political reasons, they replied that it is the matter of work dispute and directed me which legal steps I should take about that. Nevertheless, it was little hard to expect that Antonella Cerasino would warn on replacements of chief editors and mark them as disconcerting. Namely, in time about she is talking about, only three replacements in leading positions have happened in Croatian print medias: Denis Romac resigned on position of chief editor in Novi list (private media), Andrea Latinovic resigned on position of chief editor of Vjesnik (the paper owned by Government of Ivo Sanader) and from a position of chief editor of privatised Slobodna Dalmacija, replaced is Drazen Gudic. I don't believe that OSCE has any objections on changes in Novi list and Slobodna Dalmacija, because those are private medias, and OSCE supported privatisation of state print medias. Furthermore, I have no knowledge that Romac or Gudic complainted that their leaving is conditioned by political pressures. Vjesnik is state media (for whose control OSCE has mandate) where Government's Management, contrary to suggestion of HND (Croatian journalist association), without public contest, gave position to Andrea Latinovic last year, and also this year, without public contest, on her position placed Darko Djuretek. As far as I know, in mandate of Andrea Latinovic, exactly OESS protested because of some headlines in Vjesnik. Now I'm totaly confused. I complained to OSCE that the state through Andrea Latinovic put pressure on me, that they left me without existence, and OSCE is worried because former chief editor of Vjesnik resigned and stayed on commentary salary in Vjesnik. I please the representatives of OESS in Zagreb to give their comment on 45 lines (or Peratovic Net)!

P.S. OSCE in 6th July of this year presented also its REPORT ABOUT STATUS NR.16 ON THE PROGRESS CROATIA MADE IN MEETING ITS INTERNATIONAL COMMITMENTS SINCE NOVEMBER 2004. And in section Media Freedom is written:

The debate on how to reconcile the work of the secret services with an effective protection of fundamental human rights and journalistic freedom has been in the spotlight during most of the reporting period. Although the Croatian Journalists’ Association expressed its satisfaction at the conclusions of Parliamentary Committees who investigated in March cases where the Counter Intelligence Agency (POA) had allegedly violated the human rights of journalists, some media commentators concluded that the investigations did not result in any concrete proposal for a change of the rulebook of POA or the Law on Security Services.

Concidering that my case is mentioned here, my duty is to warn OSCE that Tomislav Karamarko made such changes in the Law of safety services, which they would like for sure. Karamarko is chief of POA and great friend of Andrea Latinovic, with whom, by her words, had lunch at five o'clock and talked about the author of 45 lines. (and Peratovic Net) That conversation for result had my dismissal in Vjesnik. Ugh, yes! That is by OSCE in fact only work dispute, or as recently wrote to me untouchable crest of moral print –that was some game of yours.

MUNICIPAL COURT IN ZAGREB Legal matter: PROSECUTOR: PERATOVIC ZELJKO, from Zagreb, III Pile 25 Represented by: attorney Irena Radic DEFENDANT: VJESNIK P Ltd., Zagreb, Slavonska avenija 4 COMPLAINT Because returning employee on job and payment of lost salary I The prosecutor is employee of the defendant on undetermined time on employment position journalist-senior associate IV, and which labour relation is regulated by Work contract on undetermined time since 18.02.2002. year. On the day 04.08.2005. the defendant brought Resolution of irregular dismissal of Work contract, by which for the prosecutor is canceled Work contract because of serious violation of working duty for reason because on the day 22.07.2005., as the author, have published a big interview with Pavle Gazi in public paper «Feral Tribune», and he didn't ask for consent of his employer. Therefore, the defendant consider that the prosecutor in that way commited specialy serious violation of working duty, by which is disrupted relation of confidence of employer and worker and because of such act of the prosecutor continuation of working relation is not possible. Furthermore, the defendant in explanation of Resolution of irregular dismissal of Work contract quote that the prosecutor in 2002. was warned for not fulfilling his obligations in accordance with regulations in Book of working regulations, because, namely he was fulfilling his works in unsatisfactory way by range and quality. The prosecutor in legal term on day 29.08.2005. made appeal on subject resolution. EVIDENCE: expected recognition from the defendant, the Work contract of the prosecutor since 18.02.2002., copy of the defendant's Resolution of irregular dismissal of Work contract since 04.08.2005., copy of the prosecutor's objection since 29.08.2005., if necessary other evidences II After enclosed objection, the prosecutor received a resolution of employer-defendant, by which the defendant determine that there is no basis for changing Resolution of irregular dismissal from 04.08.2005. because the prosecutor violated rule article 5 of Work contract and article 56. section 1. point 16. of Book of working regulations. Article 56. section 1. point 16. of Book of working regulations says: «that worker must esteem article 92. of Law of work (legal prohibition of match), and section 2. of the same article says: «because of disregard of this working duty the employer can cancel Work contract, and if it is especially hard violation by which the process of work is obstructed, and in that or another way, cause material damage or obstruct reputation of papers Vjesnik, an irregular dismissal of Work contract can be given.» In accordance with previously quoted regulation of Book of working regulations comes that violation made by prosecutor is no such hard violation of working duty which would justified irregular dismissal, so this Resolution of irregular dismissal to prosecutor illegal. Furthermore, the prosecutor quote that he thinks that by publishing of subject interview in public papers «Feral Tribune» didn't make any material damage to the defendant, or his reputation obstructed or in any other way obstructed the working process, so the conditions from article 56. section 2. of Book of working regulations for giving irregular dismissal of Work contract to the prosecutor are not fulfilled. Also th edefendant in explanation of Resolution of irregular dismissal of Work contract and in answer on objection of the prosecutor didn't explain in any way subject resolution, although he referes on rules of Book of working regulations which clearly and briefly found reasons for making Resolution of irregular dismissal of Work contract. Namely, by article 114. of Law of work the parties can irregularly dismiss Work contract: «if because of especially hard working violation or because of some other especially relevant fact, considering all conditions and interests of both contract parties, the continuation is not possible.» Considering that article 56. section 2. of Book of working regulations clearly points out reasons for irregular dismissal of Work contract, the prosecutor claims that the same are not fulfilled and that this Resolution of irregular dismissal illegal, because it is not in accordance with demands from Book of working regulations, which is used in making this very Resolution of irregular dismissal. In favor of this claim that subject Resolution is illegal, emphasized is that is well-known that such offence done by journalists who work at defendant, don't have irregular dismissal of Work contract as a result. Namely, in 2003. the journalist of defendant, Marijana Matkovic and journalist Adriano Milovan, cooperated with other medias and because of that cooperation punished with destimulation of salary in amount of 1.000,00 kunas, although at that time was on rule also subject Book of working regulations and article 56. section 1. point 16 and 2 of the same one. It is obvious that the defendant by making disputable Regulation of irregular dismissal of Work contract towards the prosecutor didn't act in the same way towards other employees, because for such violation only to him is irregularly dismissed Work contract. The prosecutor also wasn't getting his salary since the day of termination of working relation, and that is 16.08.2005. when the prosecutor got Resolution of irregular dismissal of Work contract from the defendant. EVIDENCE: expected recognition of the defendant, the Book of working regulations of the defendant, Work contract of the prosecutor, interrogation of the prosecutor, interrogation of witness Marijana Matkovic and Adriano Milovan, both on address of the defendant, by need financial expert evaluation, by need others evidences III The prosecutor quotes that disputable interview which he published in public papers «Feral Tribune» and whic on the day 22.07.2005. and publicly published in mentioned public papers, made out of his working time, and that he in accordance with regulations of Work contract, on the day 11.07.2005. at 14:54 hours handed over to the chief editor Andrea Latinovic, who without any explanation disallowed its publishing, and for which direct cognitions has editor Nada Dmitrovic. On the day 12.07.2005. the prosecutor talked with assisstant of the director, dr. Goran Popovic about diputable text, and he was ready to make corrections in that text, and all in accordance with the defendant's general editor approach, who informed him that he would talk to the chief editor of the defendant, Andrea Latinovic, and that he would be informed about everything in time. Considering that he didn't get any oral or written explanation, the prosecutor led by journalist principals of in time and truthful informing of public decided to publish the interview in public papers «Feral Tribune» on his own expense. The prosecutor is a journalist whose texts were awarded by international journalist associations (The award of Reporters without borders of Austria, by award Press Freedom Award 2003.) because of in time and truthful informing of public, and his decision to publish this text without approval of the defendant, was only made led by journalist principle of in time and truthful informing of public. On quotes in Resolution of irregular dismissal of Work contract since 04.08.2005. that the prosecutor even in 2002. was warned that he didn't fulfill his obligatios in accordance with rules of Book of working regulations, because he supposedlly unsatisfactory was doing his job by range and quality, the prosecutor says that subject quotes are not accurate, and in favour of that he quotes the fact that at that time he was by chief editor Kresimir Fijacko and his deputy, Miroslav Lezaja and executive director, Zlatko Herljevic, suggested for award of Croatian journalist association fir investigative journalism, and what he wouldn't be for sure so if the prosecutor worked his job in unsatisfactory way by range and quality. EVIDENCE: interrogation of the prosecutor, interrogation of witness Nada Dmitrovic, Goran Popovic, both on the address of the defendant, by need other evidences IV Considering that the defendant refuses to take the prosecutor back to work and pay him off his lost salaries, the prosecutor suggests that court give v e r d i c t 1. The Resolution of the defendant from 04.08.2005. of irregular dismissal of Work contract is canceled and to the defendant is ordered to take back the prosecutor on his job on which he was working before illegal termination of working relation in term of 8 days. 2. To the defendant is ordered to pay off the lost salaries to the prosecutor since 16.08.2005. till taking back the prosecutor on work, together with belonging lawful default interest since the day of arrival of every single monthly amount of salary till the pays off, and also to compensate to the prosecutor the trial costs, and all in term of 15 days. Matana SPLIT – Mario Barisic, en tidligere militærpolitimann, mener at de 8 tiltalte i Lora-saken ikke er skyldige, derimot noen andre personer som har mye høyere rang i militær- og etterretningshierarkiet. Barisic beskylder Tvrtko Pasalic, Mihael Budimir, Frane Goreta, Zeljko Maglov og helt opp til nå avdøde forsvarsminister Gojko Susak. Statsadvokatene har avslått Barisics søknad om å bli tatt inn i vitnebeskyttelsesprogrammet på grunn av drapstrusler rettet mot både ham og familien hans. Derfor påberopte han seg en bilulykke fra 1993 som er årsak til at han av og til lider av amnesi og han samtykket i at hans tidligere forklaringer leses opp. ”Jeg har sett ni fanger som ba om å bli drept, etter dialekten å dømme vil jeg tippe at de kommer fra Montenegro eller Trebinje. På gulvet var det en blanding av blod og vann, på bordet i dette rommet sto det en induktortelefon. Man kjente en intens stank, de fleste var vansiret, noen gurglet som om de ikke hadde tunge, noen manglet ører og noen var uten øyer. Jeg forhørte meg litt senere hva som hadde skjedd med disse personene, angivelig hadde to blitt sent med til fangebytte, mens syv hadde blitt kastet i gropen. Jeg informerte president Tudjman om alt det jeg hadde sett ved de par besøkene i Lora, det ble dannet en nemnd, men det eneste som kom ut av det var at alle forbrytere og kriminelle ble belønnet og jeg ble sakt opp,” forklarte Barisic.

Matic SPLIT – ”Jeg husker det og jeg fastholder ved det, av jeg i fengselet i Lora så mennesker som hadde fått ørene avskåret og øynene tatt ut. Jeg husker også at jeg navnga konkrete personer ansvarlig for dette, men de sitter ikke her.” Med disse ordene innledet den tidligere militærpolitimannen Mario Barisic sin forklaring ved vitneavhøret i går under rettsaken mot 8 tidligere militærpolitimenn, tiltalt for at de i juni 1992 i militærfengselet ”Lora” skal ha begått krigsforbrytelser mot den sivile befolkningen. Det var Ivica Livaja som åpnet jerndøren til blokk ”C” for dem, der inne var tre militærpolitimenn som vitne ikke kjente, og jeg ville heller ikke i dag kjent dem igjen. Inne på rommet var det et stort bord og på bordet sto en induktortelefon, han synes også en blodig kniv, men er ikke sikker. På gulvet var det en blanding av blod og vann. Barisic ble oppmerksom på klynk og stønn som kom fra fangene som ba om å bli drept. Før Barisic ble avhørt ble retten gjort kjent med at han har sent søknad til statsadvokatembete om å bli tatt opp i vitnebeskyttelsesprogrammet på grunn av drapstrusler rettet mot han og hans familie. Til tross for at man ser alvorlig på Barisic sine opplysninger, ble søknaden hans ikke innvilget fordi det ikke finnes noe lovlig grunnlag for dette.

DARKO MILKOVIC VAR VITNE TIL UGJERNINGER I DET MILITÆRE FENGSELET KULINE I SIBENIK Ville drepe lederne ved politiet i Sibenik Men først måtte man drepe noen serbere slik at drapene på politiledelsen ville se ut som hevn Av: Zoran Krzelj Ved den kantonale domstolen i Sibenik pågår det en rettssak mot Tvrtko Pasalic, en av de tidligere kommandørene i militærpolitiet. I følge tiltalebeslutningen som ble fattet den 28. desember 2001 har Palasic fra begynnelsen av april til medio juni 1992 oppmuntret Mario Barisic og Milorad Paic til drap på Nikola Vukusic, politisjefen i Sibenik, og nestleder Ivo Fustin, bare at de først skulle drepe ”noen serbere” – politiinspektøren Dragan Njegic og sivile Ljubo Pavasovic, slik at drapet på Vukusic og Fustin ville se ut som serbernes hevn. Barisic og Paic fortalte dette til Vukusic og Fustin og deretter til en rekke militære, statlige og politiske ledere, blant annet til Franjo Tudjman. De fortalte også om andre detaljer i forbindelse med militærpolitiets handlinger i Dalmatia, deriblant i Lora. En avskrift fra møte hos president Tudjman, avholdt den 26. april 1993, vitner om dette. Tilstede under møte var Gojko Susak, Tomislav Sutalo, Ivan Jarnjak, Jure Radic, Hrvoje Sarinic, Mile Cuk og Miroslav Tudjman. På den ene siden er vitneforklaringen til Darko Milkovic viktig for historien om Lora fordi den bekrefter forklaringen til ”kronvitnet” Mario Barisic og dermed dementeres at sistnevntes påstander er ”passende oppspinn for dagens politiske formål”. På den andre siden er Milkovics vitneforklaring om hendelsene i Kuline viktig fordi den gir direkte innsyn i hendelsene og ugjerningene som ble gjort der. Fangene ble slått av alle ”Blant de første fangene i Kuline var de rundt 15 personer fra Nos Kalik, en landsby ikke langt fra Miljevci som ble frigjort i begynnelsen av 1992. Jeg hadde nettopp begynt i militærpolitiet så jeg var ofte der. Den gangen hadde Tvrtko Pasalic kommandoen, mens 1. og 2. tropp ble ledet av Zeljko Maglov og Zvonimir Cigic. Jeg begynte med å sette sammen transportenheten. Maglov og hans venn Gojko Zivkovic viste en spesielt umenneskelig oppførsel. Fangene ble slått av alle som kom til fengselet. Frane Goreta kom også ofte. Fangene ble torturert i de sene natterstimene, for da kom Maglov og de andre fulle og dopet. De ble tvunget til umoralske handlinger og de ble voldtatt. Maglov og hans venner likte å kortslutte fangene på ledningene til felttelefonen, slik at de hoppet av støtene.
Zeljko Maglov
Rundt den 18. juni 1992 kom Frane Goreta med Ivica Livaja. Han sendte beskjed til Pasalic om at han ventet ved veien til fengselet Kuline. Med seg hadde han Zeljko Maglov. Litt senere møtte jeg på Maglov. Han var meget nervøs og hastet hjem. Jeg dro til Kuline og spurte Damir Borsic, fengselslederen, hva som hadde skjedd. Han sa at de var fire som kom for å avhøre fangene. Det var Goreta og Livaja som ledet avhøret. Det var Marko Madjar sin tur. Borsic sa til meg at Goreta kom ut helt tilsølt med blodsprut, så han viste Goreta hvor han kunne vaske seg. Madjar lå på gulvet helt livløs og blodig. Ambulansen kom og kjørte han bort i retning Split, men jeg vet ikke hva som skjedde til slutt. Den gangen samarbeidet Borsic med Barisic og informerte ham om alt i brev. Drap av fanger Miljevci ble befridd den 21. juni. Etter at kampene hadde opphørt ble noen fanger drept, om lag 15 ble tatt med til Kuline. To dager senere, ved 9 tiden om morgenen, ringte Davor Skugor, den gangen nestleder ved logistikkavdelingen i den 113. brigade, vakthavende avdeling for militærpolitiet. Han ba om at krigsfanger og et kompani militærpolitimenn ble sendt over for å begrave drepte fiendtlige soldater i Miljevci. Kompaniet ble ledet av Gojko Zivkovic. De kom med en transportbil og en mindre personbil. På veien tilbake ble det oppdaget at en av fangene hadde blitt drept. De drepte ble imidlertid ikke begravd etter internasjonale konvensjoner, men kastet i gropen ”Bacica jama”, bak landsbyen.

Jeg har vitnet om dette i retten i Zagreb. Luka Vujic, den gangen leder for den 142. brigade, skrev den 28. juni opp at noen av fangene som ble drept under aksjonen er identifisert og i beretningen nevner han Miroslav Subotic som ble drept etter at aksjonen ved landsbyen Miljevci var avsluttet.

Interview for Novi list Rijeka, 12. 09. 2005 Den gjentatte rettsaken for forbrytelser begått i det militære fengselet Lora begynner i Split i dag. Den tidligere militærpolitimann Darko Milkovic vitner fra Norge: Susak og Tudjman visste alt! Vi har innrapportert kriminal og mishandling til selveste toppen av staten. Jeg er helt sikker på at det var grunn til at vi ble fjernet fra tjenesten, etter stor press for å glemme det vi visste. Det var mye som skjedde der, sier Darko Milkovic Av: Zoran Krzelj Slik det ble forhåndsomtalt i mai av dommer Spomenka Tonkovic, formann av Tribunal for krigsforbrytelser ved fylkesrett i Split, begynte i dag den gjentatte rettsaken mot åtte personer anklaget for krigsforbrytelser. Anklagen gjelder forbrytelser begått på tidlig 1990- tallet mot sivile fanger i militærfengsel i krigshavnen Lora. Dommer Tonkovic sa at over femti vitner fra Kroatia og Serbia og Montenegro kommer til å bli avhørt i denne saken. Av de åtte som er anklaget for forbrytelser er det Tonci Vrkic, Davor Banic, Ante Gudic og Andjelko Botic som sitter i varetekt. Den første anklagede Tomislav Dujic, samt Miljenko Babic, Josip Bikic og Emilio Bungur er fremdeles på frifot og de skal dømmes in absentia. Anklagede var medlemmer av den 72. bataljonen av militærpoliti. De er anklaget for å ha torturert sivile fanger. Som følge av skader påført av torturen og skudd fra pistol døde Nenad Knezevic og Gojko Bulovic i juli 1992. Vi minner om at Høyesterett annullerte frikjennelse fra forrige rettsaken ledet av den omstridte dommeren Slavko Lozina. Saken ble sendt tilbake til fylkesretten for en ny rettssak. I sin forklaring etter frikjennelsen sa dommer Lozina likevel at forbrytelser i Lora fant sted. Med unntak av tidligere militærpolitimenn Mario Barisic og Milorad Paic var det ingen av de anklagete under den første rettssaken som kunne huske forbrytelser som skjedde i fengselet. Selv de som har gitt vitneforklæring på forhånd, ”kunne ikke huske” disse hendelsene under rettsforhandlingene. En av daværende militærpolitimenn hvis navn ble nevnt i retten men som selv ikke vitnet om hendelsene i Lora er Darko Milkovic. Han er, ved siden av Mario Barisic den andre viktiste vitne også i ”Sibenik saken” som handler om kriminal og forbrytelser begått av medlemmer av det kroatiske militære og MP. Han har bodd i Norge de siste tre årene.

Alle gjorde det de ville Han kom til Split sammen med Mario Barisic og Paic fra Sibenik, der de var nærmeste medarbeidere i militærpolitiet. Fort ble de kjent med hendelsene i Lora. Rett etter det advarte han, sammen med kollegaene om urettmessigheter i militærpolitiets arbeid: kriminalitet men også andre hendelser som tortur av fanger i Sibeniks militærfengsel Kuline. Han har ved flere anledninger, gjennom mediene og i rettssalen bekreftet Barisics vitneutsagn om tilstandene i militærpolitiet. Etter det ble han og familien hans utsatt til seriøse trusler. Da han ikke fikk noen beskyttelse fra den kroatiske staten, bestemte han seg dra med sin familie og søke asyl i Norge. Før den gjentatte rettsaken snakket han igjen om hendelser i Lora. - I begynnelsen av april 1992. kom Tvrtko Pasalic fra Sibenik til 72. bataljon. Han ble utnevnt til NK mens det var Zdravko Galic som var kommandanten. Før ham var det en viss Maretic. Selv om Galic var i kommandoen, var det Pasalic som var person med mest makt. Han var den som bestemte alt. Da jeg begynte å komme dit, så jeg mange fanger som ryddet og vasket rommene. Da hørte jeg rykter om at det er full kaos i fengselet og at alle ansatte gjøre det de vil. Maretic var uinteressert, det samme med Galic. Fengselssjefen Dujic gjorde ting slik det passet ham. Hans kone, Tanja var leder av vakttjenesten. Etter at Tvrtko Pasalic overtok kommanden pleide han å dra ofte til Sibeniks MP. Det var der han hadde møter med oss- Mario Barisic som var leder av kriminalpolitiet, politimannen i samme avdeling Milorad Paic og meg som var leder av trafikkorpset. Ved en anledning beordret han at Barisic, Paic og jeg skal dra til Split. Barisic og Paic skulle kontrollere militærvaretekt De fikk beskjed om at de skal ta med seg en politimann til. Valget falt på Damir Borsic som var kommandanten av militærvaretekt Kuline i Sibenik. Jeg skulle organisere trafikktjenesten fordi det var mange biler som ble brukt ukontrollert. Tvrtko bedømte at det var kaotiske tilstander i militærpolitiet og at noe måtte gjøres med det. Fengsel for uregistrerte - Hva var det dere så og hørte der? - Den første dagen kom Barisic til Dracevac og rapporterte til Tvrtko om det som skjer. Han ba ham om å skrive det ned. Jeg var tilstede under samtalen og ble igjen på kontoret sammen med Tvrtko etter samtalen. Da kom det inn Palavra, assisterende logistikksjef i den 72. bataljonen. Tvrtko begynte å kjefte på ham ”hva slags assisterende logistikksjef han var” da alt manglet i varetekten. Det var ingen senger og andre ting og ingenting fungerte fordi ingen gadd å gjøre noe. Palavra sa at han skulle prøve å skaffe alt men at han er i en vanskelig situasjon fordi Maretic og Galic unnlot å gjøre noe fordi de ga blaffen. Tvrtko beordret ham å fikse alt umiddelbart og å hjelpe Barisic og Paic. De skulle sette varetekt i normal stand fordi forskjellige kommisjoner og internasjonale humanitære organisasjoner, først og fremst Røde kors, begynte å komme innom for å sjekke. Tvrtko beordret meg å sette minst en bil, men helst to hvis mulig, til disposisjon for fengselet til enhver tid. Bilene skulle brukes til transport av krigsfanger til legen og andre formål. Jeg var enig i det. Man kan si at situasjonen ble bedre etter at Pasalic kom. Etter noen dager møtte jeg Barisic igjen, denne gangen i militærleier Dracevac i Split. Jeg sporte hvordan det gikk på fengselet fordi jeg fryktet at det er like ille som i Sibenik. På den tiden pleide jeg å se Frane Goreta møte med Pasalic hver dag. Når Pasalic ikke var til stede pleide han å ta med seg Ivica Livaja, nestleder i IPD tjenesten (Informativ og politisk virksomhet). Han besøkte ofte også Tanja Dujic og dro sammen med henne ut av militærleieren. Barisic sa til meg at det gjenstår mye arbeid på fengselet, og at han gleder seg til å dra tilbake til Sibenik fordi det var full kaos i Lora. Fangene hadde ingen sted å sove, de maltrakeres hver dag og han hadde oppdaget en uregistrert blokk ”C”. Det var Pasalic selv som viste ham blokken og forklarte at dette er fengsel for ”uregistrerte fanger som besøkes av spesielle gjester”. Kunne ikke lenger se tortur Har Mario Barisic sagt noe om forbrytelser? - Barisic fortalte meg at følte seg syk da han kom inn. Det luktet vondt og han så blod. Fangene har ligge på gulvet og noen av de hadde en teppe. Alle var stygt skadet og blodige. Noen hadde ikke øynene, andre ikke tungen tredje greide ikke å stå opp. Han nevnte også en ortodoks prest fra Kupres. Da han kom inn sa fangene: ”drep oss, vi kan ikke holde ut mer av dette!”. Han sto sjokkert uten å vite hva disse fangene gjøre der. Da kom Ivica Livaja som lo. - Hva gjorde Barisic da? - Han beordret at fengselet skal males, laget lister over folk som har tillatelse å komme inn og møblert rommene med nødvendig utstyr. Mens jeg pleide å komme til Lora, kom jeg kun til inngangen i varetekt men orket ikke å gå inn, selv om jeg ble invitert av andre. Mario var en av de som inviterte meg. Jeg svarte alltid at jeg skulle ventet utenfor. Jeg visste hva som foregikk i Sibenik, hvem var ”besøkende” og orket ikke mer se på torturen av fanger. - Når var det du snakket om dette igjen med Mario? - Jeg kom tilbake til Sibenik i mai. Mario og jeg snakket igjen om alt. Han fortalte meg at vi på dette tidspunktet kan ikke avdekke noe, men at det finnes skriftlig materiale om alt. Alt var hysjet ned - Dine anklager er seriøse. Jeg tror på Mario. Vi var sammen fra første dagen og jobbet for å fjerne kriminal og andre ulovlige handlinger i militærpolitiet. Han ville ikke delta i forbrytelser og likvidasjoner. Jeg var hans nærmeste medarbeider og vet det. Takket være oss var ikke general Janko Bobetko likvidert. Heller ikke polititopper i Sibenik, Nikola Vukusic og Ivo Fustin. Vi støttet hverandre i vanskelige tider. Om det som foregikk, kriminal og forbrytelser, varslet vi statstoppene. Jeg er helt sikker på det at dette var direkte årsak til at vi ble fjernet fra tjenesten. Vi ble også presset til å glemme det vi vet. Tiden viste hva slags kriminalitet var det dette dreier seg om. Det var alt: fra smugling av narkotika til smugling av stjålne biler. Noen av de som i dag leder militærpolitiet deltok i dette. Alt var hysjet ned. Ivan Juric og Mihael Budimir avanserte i hierarkien og Maglov kunne gjøre det samme om han var litt smartere. Marijan Biskic og Mate Lausic kunne bli i sine stillinger uten at noen stilte spørsmålet ved det. Siden MP var direkte under ministeriet alle som angrep oss nevnte ministeren. Det var helt på det rene at den som hadde mest interesse av å hysje det hele ned var den som var på toppen av alt: Gojko Susak. Det forklarer den massive kriminaliteten, tortur i fengsler, mord, ran... Det forklarer også faktumet at mange med tjukke mapper hos kriminalpolitiet fikk anledning til å jobbe i militærpolitiet. Det er stor synd for Kroatia at ting ikke ble håndtert da vi advarte om det.

Henrettelse av den ortodokse presten Var det flere som fortalte deg om det som skjedde i Lora? - En kveld på forsommeren kom Pasalic til militærleier sint fordi en ortodoks prest ble drept på fengselet. Mannen ble torturert hver dag og Tvrtko var spesielt sint fordi presten ble drept av hans sjåfør med spark i hodet. Han sa det da jeg var tilstede sammen med Barisic og Paic inne i garasjen til MP Sibenik. Mario spillte for meg i ettertid en kassett der han gjorde opptak av Livaja. På kassetten kan man helt tydelig høre at noen fra ”C” blokken ble drept og at ”sammen med de endte Goreta, et sted på Klis”.

I will suggest Markov because of this statement:

THE PRESIDENT OF COUNCIL FOR NATIONAL SECURITY OF CROATIAN PARLIAMENT, YESTERDAY IN ZADAR BROUGHT OUT THE NEWS ABOUT RUNAWAY GENERAL Markov: Croatian secret services in conntact with Ante Gotovina I'm not in conntact with general, but I can confirm that Croatian secret services are, said in brief conversation after press conference Ante Markov. Sinisa KLARICA, Novi list, 28.06.2003.

Namely, Franjo Turek, at that time chief of POA, was signing operative reports, analysing my texts about Gotovina, claiming that it was uncorrect and that I work against interests of Croatia. Turek was sending those reports to Ante Markov, and who, besides he knew for conntacts of Ante Gotovina and Croatian secret services, as he said to Sinisa Klarica, allowed Turek's further manipulation over me and accusations that I work against interests of Croatia. If yet Turek would say that interest of Croatia was that «our secret services are in conntact with Gotovina», I would confess that I have worked against such state interest. Recently to public was showed Turek's letter to Council for internal politics and national sacurity, addressed to President of Council, Ivan Jarnjak, in which he complainted on conclusions of Council which was founded in case of five journalists. Turek claims that with all his work was familiar Prime Minister Sanader, who after Presentation about «enemy activities of journalists and former chief of police, Ranko Ostojic», appreoved warrant for doing such new measures of secret surveillance of POA over Ostojic. Turek publicly confirmed that quotations published in medias from his letter to Ivan Jarnjak, were accurate. Because of that I'm more convinced that Prime Minister Ivo Sanader was very familiar with Turek's jobs on protection of Ante Gotovina and accusations of the journalists. Turek's recent claims confirmed also statement of Dusan Miljus, editor in Jutarnji list, gave to Boris Pavelic for Novi list:

This is also proof that Ivo Sanader with illegal materials which he got from Franjo Turek (maybe even before the elections) intented in Miljus's case, through his subordinated spokesman, Ratko Macek, tried even to blackmail the journalists. I tried to settle with Government, because POA violated and still do, my human rights. It didn't work out. In the name of Government, County state attorney's office denied my suggestion as unfounded. Now Prime Minister Ivo Sanader will get an opportunity to explain on court his role in violation of human rights of journalists by POA.

I also wanted to check some datas, so I phoned spokesman of HDZ, Ratko Macek. When I asked him, he replied sharply, threatning with probable tape of my conversation with the chief of police, Ranko Ostojic. He also added to give his regards to at that time spokesman of police, Zinka Bardic, and journalist of Jutarnji list, Ivanka Toma, because that we are all members of some same group», retelled Miljus, year lasting prominent lournalist-investigator of section black chronicle of Vecernji list and President of Association of courts reporters of Croatian journalist society. Silence in State attorney's office Unpleasantly surprised, Miljus informed about everything the spokesman of police, Zinka Bardic, and she about that, as she confirmed to us personaly yesterday, wrote an official note. «It is correct. About that event I made an official note and gave it to chief of police, Ranko Ostojic», said Bardic, precising that it happened in first half of December 2003., that was, between parliamentary elections and forming Sanader's Government, when HDZ still didn't take over the ruling.
Yesterday Ranko Ostojic confirmed that he received official note from Zinka Bardic. «At that time spokesman of police has sent me an official note, what is a normal thing. In that note, in form of notification, she wrote about knowledge that the journalist said what he said», said Ostojic, which document he passed on to criminal police, and it to State attorney's office, which didn't replied yesterday on question of our papers, what happened with that document. - When I today connect some things, a lot of it is much clearer to me, comments today Dusko Miljus. He also doubts that Macek's threat could mean that HDZ, even before taking over the ruling – and certanly before March 2004., when POA gave its «Presentation» for top of the state – had materials which Counterintelligence service (POA) collected in illegal eavesdropping of Ranko Ostojic and who knows else.

Macek: Insinuations and untruths «Those are insinuations and untruths which I completely deny. I have never said something like that to Miljus. I really don't understand what is itall about. The truth is that Miljus called me for informations about Branko Vukelic, but I certanly didn't tell him what he claims. Sad indeed», denied yesterday Miljus's claims for our papers spokesman of Government, Ratko Macek.

Turek was preparing the field Ranko Ostojic himself – the only police functionary in Croatia who ever arrested some of Haag's accused – even from before doubts that exactly then, in second half of 2003, he was eavesdropped. «The doubts in that I gave one year and a half before, when from Committee fo civilian supervision asked for investigation. Namely, the public knows, that I was, by approval of Supreme court, eavesdropped after 5th of March 2004. But, «Turek's presentation» was made before that, and such document couldn't be made without necessary elements. Now it appears that Turek was eavesdropping even before parliamentary elections, just to prepare field for keeping his position after changing of government. In all that, nevertheless, the key question stays without answer: if Turek really in his «presentation» discovered some conspiracy group against Croatia, why he didn't act, but he neglected his job, counterintelligence protection of his own country?», ironises Ostojic.
What ever, the testimony of Dusan Miljus in the middle of «Turek affaire» opens serious doubt that on POA's list of tracked and eavesdropped ones should add – at least one more name. Boris PAVELIC

Markov recognized that in whole story about general Gotovina in one way was evaded that very important Parliamentary Council, something like it was in a case at his previous Djurdja Adlesic, who was from one side obstructed from her party colleague and vice president of Government, Goran Granic, mostly in solving the situation inside of intelligence community. Nevertheless, Markov added:
- The testimony of former American ambassador, Peter Galbraith, on trial of former Yugoslav President, Slobodan Milosevic in Haag, undoubtly goes in favour of solving the Gotovina case. ICTY accepted also President Stjepan Mesic as a partner in all initiatives and I think that progress of situation for general Gotovina is in positive way. In spite of claims of some politicians from former government that all documents were available to the police since 1995., I didn't see any documents from Brijuni's congres of military top of the state, which was held exactly before action Oluja and which namely accusing general Gotovina. I'm not in conntact with the general, but I can confirm that are in conntacts Croatian intelligence services, said in brief conversation, after press conference Ante Markov.
- Based on programme which founded City council of HSS, this party definitely goes alone on elections, and expects that on won 15-20 per cent of votes, make a leading role in future ruling coalition!- said Markov. He emphasized that in his statement in favour goes present rating of HSS, but that in preelection campaign will be no talks about past, but about projects for future, without ideological characteristics. Dat is de voorlopige conclusie die de Kroatische regering trekt na de aanslag met een bombrief, maandag, op de Britse ambassade in de Kroatische hoolfdstad Zagreb. De brief met efplosieven krwarn tot ontploffing in de postkamer van de ambassade waarbij een mederwerker licht werd verwond. Na een dag van wild speculeren, waarbij zelf werd gedacht aan een actie van internationale terorreurnetwerken, kwam gisteren de Kroatische politie met de dader op de proppen: man die gewond werd had zélf de briefbom binnen gesmokkeld. En daar moet men het voorlopig mee doen. Al blijft het vermoeden dat de dader opereerde in opdracht van „groepringen die Krotië's ambities om EU-Lid te worden willen frustreren,“ zoals de Kroatische premier Ivo Sanader het uitdrukte. Welke „groeperingen“ worden bedoeld weet elke Kroaat: de criminele netwerken rondom de voortvluchtige generaal Ante Gotovina die door het Joegoslavië-tribunaal wordt verdacht van oorlogsmisdaden. In de Kroatische media is de Britse regering de laatste tijd scherp gehekeld wegens haar – volgens de Kroaten – zeer harde opstelling jegens Kroatië. Volgens de Protten kan van een EU-lidmatschap van Kroatië geen sprake zijn zolang het land niet blijk geeft volop samen te werken met het Joegoslavië-tribunaal; die samenwerking laat volgens de Britte te wensen over, Weliswaar vinden alle EU-lidstaten dat, maar de Britse formuleringen zijn dermate hard dat ze de Kroatische zaak „grote schade“ hebben toegebracht. Dat Gotovina nog steeds niet aan het tribunaal is uitgeleverd kwam Kroatië in maart al dour te staan, toen Brussel verdere onderhandelingen over toetreding een halt toeriep. „Gotovina is niet in Kroatië, we kunnen hem niet vinden,“ blijft premier Sanader herhalen. Hij vindt echter weinig begrip in Brussel. Zeker na de nieuwste aantijgingen van Carla Del Ponte, hoofdaanklager van het Joegoslavië-tribunal, die de Kroatische katholieke kerk ervan verdenkt Gotovina te beschermen.

Door de zaak-Gotovina komt Kroatië niet toe aan het oplossen van de andere poeblemen, zegt Andrea Feldman, hoofdt van het Open Society Institute (OSI) dat ijvert voor democratisering van Kroatië. „Sanader zou zijn handen vol moeten hebben met het hervormen van de staatsinstellingen, zoals politie en justitie,“ zegt Feldman. In het jongste OSI-rapport wordt de Kroatische rechtspraak gehekeld wegens de trage werking en onvoldoende transparantie. Ook moeten nog tal van economische hervormingen worden doorgevoerd. Feldman: „Sanader vecht aan twee fronten tegelijk. Hij moet Europa overtuigen van zijn beste bedoelingen en tegelijk in Kroatië grote schoonmaak houden. Want de stank in de stallen van de Kroatische politiek is onverdragelijk.“ De bomaanslag drukt Sanader met de neus op de feiten, zegt journalist Zeljko Peratovic die onderzoek doet naar de netwerken rond Gotovina. „De briefbom is een plaagstootje uit de koker van Gotovina-aanhangers.“ Peratovic schrijft over de banden die regering en leger onderhouden met de maffia in Kroatië en hamert er al jaren op dat Gotovina bescherming gebiet van het leger. Peratovic werd, na meermalen met de dood te zijn bedreigd, vorige maand ontslagen door zijn werkgever, de krant Vjesnik. „Ik word omringd door lafaards,“ zegt hij. „Jedereen weet dat het eenvoudig is om Gotovina op te sporen. Er is alleen niemand die het lef heeft.“ Toch vindt Feldman dat Sanader steun van de EU verdient in zijn strijd voor hervormingen. „Toetreding is het enige pressiemiddel dat helpt. Brussel moet, los van de zaak-Gotovina, Kroatië een startdatum voor onderhandelingen geven. Anders ontspoort dit land.“

The case «Pakracka Poljana» disgraced again Croatian judicature. Although on first sight there were spectacular judgements – ten years for Munib Suljic, eight for Sinisa Rimac and five for Igor Mikola – explanation of judgement that on area of Pakracka Poljana founded a camp in which poeople were treated as in nazi time, but it is not war crime but crime in war conditions, is opposite of common sense. By that is given partly a right to former President of Supreme court, Milan Vukovic, who said that Croatian soldiers couldn't commit a war crime, because they defended themselves. Recently finished repeated trial in case «Pakracka Poljana», despite of on first sight spectacular judgements – ten years in prison for Munib Suljic, eight for Sinisa Rimac, five for Igor Mikola and four, that is, three for Miroslav Bajramovic and Branko Saric – again showed that Croatian judicature is not ready enough to face with dark part of Civil War. The explanation of judgement itself that was not a war crime but crime in war conditions, and that on area Pakracka Poljana founded a camp like nazi ones in Second World War, it is in contradiction with common sense. Namely, if Munib Suljic and Sinisa Rimac condemned for murder of Aleksandar Sasa Antic, in «camp in which people were treated as in nazi time», and Igor Mikola helped them in that, if Miro Bajramovic and Branko Saric condemned for illegal kidnaping of Serb from Zagreb, Milos Ivosevic and two workers on building-site of his house, Rade Pajic and Marko Grujic, killed in the same camp, by which logic it is not a war crime? Unpunished organisators of camp If it is known that from collecting center on Zagreb's fair (Section 22), from military custody Kerestinec, and from a place in western Slavonia under control of Croatian autorities loyal Serbs, war convicts and undesireable Croats were taken to camp in Pakracka Poljana, that is war crime itself, because there was no legal basis to do something like that. If those poor people were killed there, as it was proved in judgement, there was no basis by which judge Rajka Tomerlin Almer could conclude that it was a war crime in war conditions. Legendary statement of former President of Supreme court, Milan Vukovic that Croatian soldiers by definition couldn't commit a crime because they were defending, is said at the 90-ties exactly as a comment of first serious headlines about war crime in Pakracka Poljana. So, Milan Vukovic thought under defense of Croatia also kidnaping of loyal Serbs and undesireable Croats, their placing in «camp in which people were treated as in nazi time», where they were, honestly, killed on a bit more primitive way: not in gas chambers, but with bullet in head. In certain way judge Rajka Tomerlin Almer agrees with thoughts of Milan Vukovic. It would be better if judge didn't mention nazi character of camp in Pakracka Poljana, because then at least those totaly ignorant, but anyway more intelligent, couldn't ask: well, who organised that camp, who was the commander of it? Why didn't you punish them? Tudjman appalled over Bajramovic's claims? How come that Tomislav Mercep, commander of reserve police unit, whose members was five condemned «Mercep men», was not in custody ever because of these crimes? Even Zvonimir Trusic, owner of cafe «Stil» on Zagreb's fair as a commanding headquarters for collecting center in Section 22, at beginning 1992. with several «Mercep men», was under custody and under investigation, but Mercep didn't. «In time of incriminating events wounded lied in hospital and we couldn't accuse him», replied in 1997. Anto Nobilo, at that time deputy of county public prosecutor on question of deceased Leader Franjo Tudjman in one conversation in President's office. Tudjman and Nobilo talked about strategies of defense of Tihomir Blaskic, but Tudjman got news about interview of Miroslav Bajramovic for «Feral Tribune», so Nobilo offered to say what he knew about Pakracka Poljana case, and Tudjman asked about rolle of Tomislav Mercep in all that. By stenogram of his conversation, which «Nacional» published last year, and Nobilo publicly confirmed it, Tudjman sincerely was appalled over Bajramovic's statements that he alone killed about 70 people, and that Mercep's unit, so called «Autumn rains», in Pakracka Poljana liqidated 280 people, mostly Serbs. Consulting with Miroslav Separovic, at that time Minister of judicature, Tudjman ordered to deputy of main state attorney , Marijan Hranjski, to arrest immediately Bajramovic and others whom he mentioned that were with him in crimes. Nobilo claimed that he didn't read that interview, but that he came to similar things in 1992. when as a deputy of county prosecutor, led the first investigation. Last year Nobilo in interview for «Vecernji list» boasted that he said to Tudjman that everything what Bajramovic said for «Feral» was correct. Bajramovic fake witness – provocateur? In fact, exactly that interview of Miroslav Bajramovic is one of the key spots of suppressing of truth about Pakracka Poljana and honest processing of all outrages that happened there. Miroslav Bajramovic was previously read by investigators of ICTY who in 1997. investigated desappearings and murders of Vukovar Serbs from 1991., in time of absolute rule of Tomislav Mercep in that town. Belgrade's professor, Vojin Dabic, who cooperated on that investigation with Graham Blewit, at that time deputy of main ICTY's prosecutor, Louise Arbour, told to the author of these lines that Bajramovic offered himself as a witness of crime of «Mercep men» in Vukovar and said about 20 names of Serbs whom, namely he and his companions, killed and threw into the Danube. -We found out that he made up all those names, and only accurate information that we got from Bajramovic is the place on the bank of Danube where corps were thrown, said to the author of these lines Dabic, swearing that Miroslav Bajramovic is proved fake witness – provocateur. It is not clear why Anto Nobilo still claims that Bajramovic's statement to «Feral» is accurate, nor why around Bajramovic at the end of 90-ties engaged Cicak's HHO. At the very beginning of the interview for «Feral», Bajramovic brings out proved untruth: «Our group is down (in Gospic, auth.rem.) liquidated between 90 and 110 people, because we were too short time, not even a month. For Gospic was an order- «ethnic cleansing»: we killed director of the post, hospital, the owner of restaurant and some other Serbs. The murders were done by a gun in a forhead, because we didn't have enough time. I repeat, from headquarters we got the order to reduce the percentage of Serbs in Gospic». From previous appearences of Milan Levar, and through all different testimonies and documents, revealed before so called Bajramovic's story, it was known that role of «Mercep men» in war crimes in Gospic in comparison of roles of Tihomir Oreskovic and Mirko Norac, was insignificant. By all this, Bajramovic's statement for «Feral» should serve to one part of goverment to show that Croatian public and Croatian government appalled over war crimes done by Croatian units, and that would immediately be processed acts about he gave testimony. Of course, as soon as he was in custody, Bajramovic denied that he gave interview for «Feral», and by that the contents of recognition.

No corps – no crime Tomislav Mercep and Zvonimir Trusic, whom Bajramovic marked as organisators of crime in Pakracka Poljana, were not in custody. And from those in custody, some useful informations in investigation to prosecution gave Stipe Mandjarelo, a man who was before the war member of the Serb-ortodox church, Gipsy, and in war, changed his identity, gave statements as he was bigger Ustasha than Ante Pavelic. The same Mandjarelo in custody suddenly got sick and died. And to make the thing more bizzare, his body was cremated, although there are rare cases to cremate bodies of catholics. But after the cremation no post mortem examination can be done, that is check the cause of the death, what is by many spactators the biggest reason why he was cremated. By rather reliable datas, the body of Marina Nuic, the member of at some time party of Marko Veselica, HDS (Croatian Demokratic Party), who was in Pakracka Poljana to give humanitarian aid, and under accusation that she was a spy, after many rapes she was killed, finished in crematorium on Salata, so for her death nobody was accused. No corps – no crime. The statement that Mandjarelo gave before he suddenly died, and there were serious indications that he would continue to talk freely if death didn't stop him in that, was used only as an evidence that two-three «Mercep men», on that first trial for Pakracka Poljana, condemn only for illegal kidnaping. Others, as Munib Suljic, Sinisa Rimac and Igor Mikola, without any judgement in June 1999. were released from prison. Prosecution didn't get any other evidences, and the court the statements of two witnesses, citizens of Serb nationality (Nikola Peles and Branko Velagic), who gave testimony in 1992. that they were forced to dig a grave for Aleksandar Sasa Antic, marked as inconsistent and contradictory. Intimidation of witness on court's hall When Supreme court in 2001. cancelled a part of judgement from 1999. and ordered another trial for «Pakracka Poljana» case, happened even bigger burlesque. Accused Suljic and Mikola, defending from freedom, on court's hall intimidated two mentioned witnesses, after what the witnesses in front of the judge showed even bigger amnesya and contradictory that on first trial. Judicial police didn't prevent such intimidation of witnesses, or reacted in any way, when in breaks of the trial, Suljic and Mikola went to the toilette, from which could be heard sniffing, and two of them with narrower pupils of the eyes, and hectic reactions continue to follow the trial. So, Suljic, Rimac and Mikola were condemned this time on basis of even more inconsistent, contradictory and more amnestyc testimonies of Pelesa and Velagic. It was unbelieveable that one of those witnesses during trial suddenly started to talk that Munib Suljic told him that «he would next time work on digging even bigger, massive grave», and that statement not prosecution nor court took into record and ordered further investigation. Also, it was absolutely unbelieveable that no Croatian investigation of crimes in Pakracka Poljana didn't take in record the act of Militaty court in Zagreb in 1993. (nr.of act:III-Kir-32/93), in which one of accused for stealing on battle field, Franjo Krcelic, claimed that he got aproval that from Serb houses he can take things he needed for his (tractor, television etc.) from his first superior Nikola Cvitanovic. To that act was attached ratification of police of Croatia nr. 511-01-231-1/92, dated 4 February 1992. addressed from Pakracka Poljana, and with which advisor of Minister, Tomislav Mercep, confirmed that Franjo Krcelic was «engaged in reserve unit of police since 1st October 1991. till 31st January 1992. on Pakrac-Lipik battle field». That time is the time of crimes in Pakracka Poljana and that is the proof that Tomislav Mercep in that time was commander of mentioned unit.

Responsibility of SDP Besides, it is not clear why Croatian judicature didn't get statements from witnesses from villages around Pakrac, Lipik, Daruvar and Kutina who gave testimonies, available to ICTY, about taking and killing their neighbours and relatives (especially is tragic story about killings lots of people of Serb nationality from village Kip). Nikola Ivkanec, chief of police in Pakrac 1993. helped with investigation about crimes over Serbs which was led by commission of UN, with Cherif Bassioni on head, which was the beginning of ICTY and which discovered graveyard with 18 corps. It is unknown whether Croatian investigators ever took statement from Nikola Ivkanec, to clear up the crime in Pakracka Poljana. For a long time the relatives of the murdered couldn't get ratification about death of their dearest. When Pakrac's judge, Vojin Mrzic, gave such one ratification to wife of Jovo Zestic, in which, among other, said that «missing Jovo Zestic died in prison Ribnjaci in Marino selo in 17 November 1991. in which with several people from village Klisa, took by members of ZNG (Cro. Army)...», the same man got a dismissal on court. The shadow of Pakracka Poljana falls on at that time leading men of SDP, who through Zdravko Tomac participated in work of Government of national unity. So, Tomac was in that Government in charge for following the situation in western Slavonia. There is also a written testimony that a member of Kutina's leading team of SDP went for previously arranged meeting with headquarters of the party in Zagreb to inform the center about crimes in his area, so the criminals kidnaped him and killed him, and from SDP center nobody didn't even protested against that. The number of murdered on several locations known under one name – Pakracka Poljana, moves from 18 , that number at the beginning managed to prove Bassoni's commission, to several hundreds, as some organisations claimed from Serbia, which were dealing with those problems. The accurate number will be known one day for sure, and on Croatian judicature stays a shame that it brought a verdict for only one killed Croatian policema, with Serb roots, Aleksandar Sasa Antic, and his companions named him for a spy, and for kidnaping but not a murder, three Serbs from Zagreb: douane worker Milos Ivosevic and two workers from his building-site, Rade Pajic and Marko Grujic. In this week's Feral Tribune one part of stenogram is published from the meeting of VONS in 1993. on which top of the state, led by Tudjman and Susak, were debating about complaints of military policemen: Mario Barisic, Milorad Paic, and under suspicious circumstances, in 1997., suffered, a man from SIS, Tomislav Matic. Together with a part of stenogram, in Feral were retelled bigger part of texts which about Mario Barisic and so called Sibenik's affair, I was publishing in Globus in 1999., without naming any source. But that bothers me less than the fact that in Feral was also a copy of stenogram which was not available in public in material kind, and state attorney from Split, Michelle Squiccimmaro didn't want to give it even to Barisic, with explanation that was the act protected by secret. That was less problem than the fact that the scenarist of documentry Lora-testimonies, Pero Jurisin in Nedjeljna Dalmacija in 2001. retold that stenogram (and recently he swore to me that he hadn't the facsimil, but that he had the right to made only notes) adding that Gojko Susak for Mario Barisic said that he should be eliminated. Exactly that part was missing in current Feral's transcript. Boris Pavelic, after Jurisin's text, called Ivan Jarnjak, who in 1993. as a Minister of police, was on meeting of VONS and asked him whether the stenogram was authentic. Jarnjak confirmed adding that Susak's eliminate didn't have to mean to kill. Yesterday Mario Barisic, on repeated trial for war crime in Lora, said that because all that he had suffered, got amnesia and he didn't remember what was happening in Lora. HDZ- government tried to kill him in the 90-ties. That of coalition, that of third January, he was not needed. Although, a man from SDP didn't fit in Racan's politics of forgiving to war criminals. Zeljko Zganjer and Mladen Bajic made a carier on his case, but because of their mistakes from the past of war military prosecutors in Sibenik and Split, although they comunicated with him personally during the investigations, they didn't have a courage for ojective bill of indictmnet to punish real offenders for war crimes and criminal Barisic was talking about in Tudjman's office in 1993. HHO didn't want to hear for media lynch which was during the first trial for Lora, almost every day against Barisic in all medias, including internet, against so brave and honest Croatian soldier.

I see that you started with politics. High and that little smaller. Our shame. For those who don't know, I must say. -grandfather of Mario Barisic was Ustasha from village Rupa: well known for his Croationalism and love for his country. He was killed by partisans (comunistic) in way that he put him in ropes and through the whole village dragged like that with horses until he died. Then a politic commessary with a knife on a gun M48 stabbed him in chest and second time in neck. Ours would say- abandu. That's how died one Croat from Rupe who adored Croatia. Then a young commessary, still alive today, but old, proudly sits in SDP in Sibenik. By the way, when his corps was pushed in a puddle of water and mud ba two partisan knights, he said: «Ustasha trash, this is going to happen with your children and all Ustasha descendants». A sorrow to be bigger, with him was one Serb by surname Tisma (from Knin somewhere) who said: «You fool, where were you born? – you are going to kill all your people». And he answered: «For Yugoslavia, my friend, for Yugoslavia and comunis party». -Super. MARIO BARISIC ( grandchild of murdered country-lover) is a member of (SDP- Croatian Socialdemocrats Party) party since 1995. Passionate pleader of justice and legal country. «Evidences» about war crimes he gives to Ivica Racan and Marin Jurjevic and asks for punishmet of «criminals». By the way, Mario answers on two questions: -With whom you met before going in Kijevo as a policeman? – What was the name of you captain of KOS in Yugoslav army? -Just to know, even if you don't answer again. You stinky brat. You chase everybody around yourself who thinks a bit as Croat. Why do you lie for your wounding? I watch you a lot. You greet me sometimes, I do the same to you. But you are so disgusting to me that I don't hate you, but despise you. Unfortunatelly, this people don't know much about you, but I will tell them. I know you and your family, and father and mother and brother and relatives, your wife and her relatives. I know all about you, more then you do. Who says that you should be killed is stinky and stupid animal. I am even against the thought of it, because Croats shouldn't live through destiny of their ancestors, even if they are betrayers. You sholuld be presented to this people and tell them WHO ARE YOU AND WHAT IS YOUR TASK, and I know that.

Zarko Puhovski told me that Barisic could be accused for participating in crime, and he was willing to help him, if talks in film of his brother, Nenad Puhovski, Lora – testimoniess. Some attorneys didn't want to press charges against Zeljko Olujic, who in Latinica on theme Storm over Krajina, called Barisic a psychic patient. The chief of police, Ranko Ostojic, didn't put policemen as a protection for Barisic, who wouldn't tell him to his enemies, justifying himself that he has no autorities for that, but Sibenik's police. Ostojic didn't take serious the fact that the group connected with runaway Ante Gotovina, and whom Mario accused for war crimes in Kuline, Lora, after in 2003. SIS and SZUP overdropped Barisic's andmine phone calls and working on chief of Sibenik's POA, Davor Matesic, in Herzegovina payed people to kill crown witness for Lora. All the time SIS was giving him friends, so like that, Sibenik's SIS man, Milan Malenica, progress all the way the position in Zagreb based on a job which Mario and certain Ivica Bacic were working on. Marko Erceg from Duga Resa and German Dillenburg, former friend of Stjepan Mesic, Silvije Degen, Tomislav Jakic, Milan Levar, deceased Stipe Suvar, Mira Ljubic Lorger, Wolfgang Thierese, Josip Manolic, Josip Boljkovac, Bernd Schmidtbauer, Smiljan Reljic, Ante Nobilo, Ivan Ninic, Karl Forzner, Josip Perkovic..., helped to transfer to Germany Tomislav Oreskovic, one of witnesses of Gospic war crimes. But he didn't manage to do the same for Mario Barisic. Mario has got international degree of master of fight with nunchacks. And he wanted to make a living in Germany as a trainer of that fighting sport. Neverthless, that his attention was discovered, and Marko Erceg was hardly attacked in Slobodna Dalmacija: Secret hunter on evidences of crimes and Heloved to introduce himself as an ICTY investigator.

You guess, Ivica is brother of Tihomir Oreskovic, condemned in Rijeka on 15 years in prison for war crime in Gospic. The chief of UNS, Tomislav Karamarko, was connected with guys for whom Barisic claimed that they were criminals, so even President Mesic didn’t stand for Mario. The Minister of defense, Jozo Rados, got the same guys on job in MORH, and his advisor for security, Ante Damjanovic, who with Barisic talked through Stipe Rojnica, chief of SIS in 1994., wanted to know only which school Barisic finished.

Did Mario Barisic gave tetimony in vain?

Projection of documentary Lora – testimonies of Nenad Puhovski and Pero Jurisin, again put in focus of public interest Mario Barisic, former military policeman from Sibenik, who first thgough institutions of system, then in medias and then in court gave testimony about war crimes and criminal acts on which worked Militaty police and Safety-informative service in MORH in Dalmatia, during war years. Praising Mario's honesty and bravery, Slobodan Snajder asked me concernedly in his mail: -And why Barisic in Split court didn't blame somebody else of eight accused, when out of all is clear that they were torturers in «Lora»? I answered that Mario Barisic didn't want to lie. He didn't see that accused from Lora torture and kill. He saw clues of a crime after it were commited: the walls of block C covered in blood, a human ear on the floor in toilette; he heared stories about crimes from other military policemen. To prevent repeating of such things, he informed about his knowledge his superiors all to President Franjo Tudjman. After his testimony in Tudjman's office, there was held a meeting of closest state top, on which deceased Minister of defense, Gojko Susak, said that Barisic should be eliminated. When a part of stenogram from that meeting appeared in public, one of the members of meeting, Ivan Jarnjak, in 1993. Minister of police, said that Susak didn't mean to kill when he said eliminate. Why that stenogram wasn't mention in documentary Lora-testimonies, it is not clear to me, particularly considering the fact that scenarist of Lora, Pero Jurisin quoted most of stenogram in his text in Nedjeljna Dalmacija and that he for sure have the stenogram of conversation of Tudjman, Susak, Jarnjak and others about Mario Barisic. When spokesman of President's Office, Danijela Barisic in 2001. confirmed that stenogram brought from Office of state attorney, I asked from at that time archivar of President Stjepan Mesic, Zeljko Bagic, to let me insight in that contorverse conversation. Bagic was convincing me that he gave the stenogram to Zeljko Zganjer, at that time County state attorney in Sibenik (today chief of USKOK) and to Mladen Bajic, present Main attorney of Croatia, Mladen Bajic, and at that time County state attorney in Split, and that he had to see what he would do about knowledge from that evidence. The key evidence which confirms that Mario Barisic informed Tudjman about criminal and crimes in MORH stayed till today unavailable for wide public. Namely it was used in process Lora, but had a mark of secret on it, so even Barisic as witness in process, even after official written demand to State attorney's office, couldn't get. Destiny of Mario Barisic in many ways is similar to Levar's. After the murder of Milan Levar in Gospic, County state attorney from Sibenik, Zeljko Zganjer, gave him a police protection, which after two years, disapointed, Mario cancelled himself. Policemen from protection betrayed him to his enemies, and he got informations that certain groups connected with Levar's murder, but also hiding of Ante Gotovina, prepared his death. Different from Levar, he received trial for some crimes about which he gave testimony, but he didn't receive to see that those he held responsible were accused – those who organized the crimes, made it possible, made benefit out of it... On these pages we will to try to give review of Mario's search for the truth and justice through institutions, medias, courts. After Levar's death, state should give him full protection and seriously investigate all his quotation, and not to try to manipulate with his testimony in Lora case, so even Slobodan Snajder could get an impression that Barisic protects direct commiters of war crimes. If Mario give up for good his hard expedition, it will not be his fault...
